Verblijf Oekraïense vluchtelingen verlengd en nieuwe voorwaarde

Richtlijn tijdelijke bescherming

Oekraïense vluchtelingen kunnen door de Richtlijn Tijdelijke Bescherming in de Europese Unie (EU) verblijven zonder asiel aan te vragen. Zij hebben recht op opvang en medische zorg en mogen werken. De periode waarin dat kan is verlengd tot en met 4 maart 2028. 

Let op! Niet elke vluchteling uit de Oekraïne valt (nog) onder de Richtlijn Tijdelijke Bescherming in Nederland. Kijk op de website van de IND wie wel en niet onder de Richtlijn valt.

Nieuwe voorwaarde

De Raad van EU heeft ook een nieuwe voorwaarde aan de tijdelijke bescherming verbonden. Iedere nieuwe aanvrager moet aantonen dat hij/zij aan de militaire verplichtingen in Oekraïne heeft voldaan of een vrijstelling daarvoor heeft.

Let op! Oekraïense vluchtelingen die al onder de Richtlijn vielen, hoeven niet te voldoen aan deze nieuwe voorwaarde.

Hoe bereken je de 34-dagen drempel uit het verdrag Nederland-Duitsland?

In de tekst hierna wordt ingegaan op de situatie waarin een inwoner van Duitsland werkt voor een Nederlandse werkgever. De situatie waarin een inwoner van Nederland werkt voor een Duitse werkgever werkt echter hetzelfde.

Let op! Voor overheidswerknemers gelden andere regels.

Belastingverdrag

Het belastingverdrag tussen Nederland en Duitsland bevat afspraken over in welk land welk inkomen belast mag worden. Zo mag Nederland belasting heffen over het loon als een inwoner van Duitsland in Nederland werkt voor een in Nederland gevestigde werkgever.

Werken in woonland

Werkt de inwoner van Duitsland voor de in Nederland gevestigde werkgever in Duitsland? Dan mag Duitsland belasting heffen over het met dat werk corresponderende loon.

Thuiswerkregeling

Om bij thuiswerken niet meteen het heffingsrecht te verleggen naar het woonland, is per 1 januari 2026 de zogenaamde thuiswerkregeling ingevoerd. Een inwoner van Duitsland die voor een Nederlandse werkgever werkt kan hierdoor in een kalenderjaar maximaal 34 dagen buiten Nederland werken, zonder dat het heffingsrecht verplaatst naar buiten Nederland.

Let op! Werkt de Duitse werknemer in een kalenderjaar meer dan 34 dagen buiten Nederland, dan verplaatst het heffingsrecht ook voor de eerste 34 dagen!

Let op! Hoewel het de thuiswerkregeling heet, gaat het niet alleen om de dagen die thuisgewerkt worden. Alle dagen die door de Duitse werknemer in loondienst gewerkt worden buiten Nederland tellen mee voor de 34 dagen drempel.

Meer werkgevers

De Belastingdienst heeft bevestigd dat de 34 dagen-drempel per werknemer geldt. Als een Duitse werknemer dus bij meerdere Nederlandse werkgevers werkt, mag hij voor al die werkgevers totaal niet meer dan 34 dagen buiten Nederland werken.

Werkgever in woonland telt niet mee

Hoe zit het als een inwoner van Duitsland voor een Nederlandse werkgever minder dan 34 dagen in Duitsland werkt, maar ook voor een Duitse werkgever uitsluitend in Duitsland werkt? De Belastingdienst heeft bevestigd dat de dagen die deze inwoner alleen voor de Duitse werkgever werkt, niet meetellen voor de 34 dagen-drempel.

Incidentele werkzaamheden op locatie

Bij de 34 dagen-drempel gaat het niet alleen om de in Duitsland thuis gewerkte dagen. Als een inwoner van Duitsland voor zijn Nederlandse werkgever incidenteel op locatie in Duitsland werkt, tellen deze dagen ook mee, volgens de Belastingdienst.

Let op! De Belastingdienst heeft ook nog vragen beantwoord over een inwoner van Duitsland die zowel voor een in Nederland gevestigde private werkgever werkt als voor een Nederlandse overheidswerkgever. Fiscale aspecten vergoeding ERE-certificaten bij elektrisch laden

ERE-certificaten

ERE-certificaten (Emissiereductie-eenheden) hebben CO2-besparing als doel. Als je een daarvoor geschikt laadpunt hebt (dat is een laadpunt met een gecertificeerde MID-meter), kun je een vergoeding krijgen voor thuis geladen kWh’s. De hoogte van deze vergoeding is afhankelijk van het aantal geladen kWh’s en de marktwaarde van de certificaten.

Let op! Om voor vergoeding in aanmerking te komen, moet je voldoen aan verschillende voorwaarden. Op de website van de Nederlandse Emissieautoriteit (NEa) is hierover meer informatie te vinden. Hier vind je ook een lijst met erkende inboekdienstverleners.

Elektrische auto van de zaak

Ook als een werknemer een elektrische auto van de zaak thuis laadt, kan de werknemer in aanmerking komen voor een vergoeding voor de ERE-certificaten. De werknemer vraagt deze zelf aan. De Belastingdienst heeft bevestigd dat deze vergoeding geen loon vormt en dus onbelast is.

Let op! Dit geldt ook voor de dga met een auto van de zaak.

Wel van invloed op werkelijke laadkosten

Vergoed je aan de werknemer de werkelijke laadkosten van de auto van de zaak, dan is dat ook onbelast. Dit zijn namelijk intermediaire kosten. Houd er wel rekening mee dat door de vergoeding voor de ERE-certificaten de werkelijke laadkosten omlaaggaan. Je kunt daarom minder onbelast aan de werknemer vergoeden als de werknemer een vergoeding voor ERE-certificaten ontvangt.

Let op! Dit geldt alleen als je de werkelijke laadkosten vergoed. Heb je met je werknemer afspraken gemaakt over doorlevering van de energie onder zakelijke marktconforme voorwaarden? Dan heeft de vergoeding voor de ERE-certificaten geen invloed op de onbelaste vergoeding. Bij zakelijke marktconforme voorwaarden is namelijk de prijs op de energiemarkt op het moment van het maken van de afspraken bepalend. Dutch Prince’s Day 2026: Ten key tax changes for entrepreneurs

Please note! Not all the points listed below are taken from the 2027 Tax Plan. Some changes had already been decided upon, but adjustments have since been made to them.

1. Fewer tax benefits for entrepreneurs

From 2027, the government will be scaling back various tax benefits for entrepreneurs.

The entrepreneur’s allowance reduces the profit on which an entrepreneur pays income tax. From 2027, further cuts will apply to various components of this allowance.

  • The self-employed person’s allowance will fall from €1,200 (2026) to €900. As a result, the taxable profit of entrepreneurs who meet the hours criterion will increase.
  • The start-up allowance will also be significantly reduced. This top-up to the self-employed person’s allowance for start-up entrepreneurs will fall from €2,123 (2026) to €10 with effect from 1 January 2027 and will be completely abolished with effect from 1 January 2028.
  • The start-up allowance will remain in place in 2027 and 2028, but will be abolished from 1 January 2029. The current maximum amounts are €12,000 in the first year, €8,000 in the second year and €4,000 in the third year.

Please note! This scheme applies to self-employed people who do not meet the 1,225-hour criterion but do meet the reduced 800-hour criterion and are entitled to incapacity benefit.

  • The cessation allowance will be reduced in one go from a maximum of €3,630 to €908.
  • The rates for the co-worker allowance will be reduced from 1.25%, 2%, 3% and 4% to 0.32%, 0.5%, 0.75% and 1% respectively.

The cessation allowance and the rates for the co-worker allowance will cease to apply at the start of the third calendar year following the year in which the reduction takes effect. As the changes come into force in 2027, the schemes will therefore cease to apply on 1 January 2030.

As of 1 January 2028, another tax benefit for business owners will be abolished: the discretionary depreciation scheme for start-ups.

Start-up business owners, those planning to cease trading within a few years, and business owners with a co-working partner will be particularly affected. The choice between a sole trader, a general partnership (VOF) or a private limited company (BV) therefore once again requires a calculation based on actual profits and personal circumstances.

Please note!If there are significant changes to your profits, business partnerships or business succession, have a fresh assessment carried out to determine which legal form is best suited to your business.

Tip! Due to the higher aggregate income, benefits may also change. You should therefore check your estimated income for benefit purposes in good time for 2027 and 2028.

2. Greater scope for travel expenses; tightening of the WKR

Employers may, with retroactive effect up to and including 1 January 2026, reimburse a maximum of €0.25 per business kilometre tax-free. This was previously €0.23. The increase also applies to commuting. The government is now enshrining this increase in law with retroactive effect.

Please note!The increase does not automatically mean that every employee is entitled to €0.25 per kilometre. This depends on the employment contract, the collective labour agreement and the employer’s own mobility policy. For employers, a higher allowance may lead to higher wage costs.

This relaxation is offset by a tightening of the work-related expenses scheme (WKR). The targeted exemption for sector-specific products is being abolished. Until now, employers were permitted to grant employees a 20 per cent staff discount, tax-free, on the market value of the product, up to a maximum of €500 per year. This exemption is being abolished. From 2027, however, the discount may still be charged to the ‘free space’. If you exceed the free space, you will pay 80 per cent final levy on the amount above that threshold.

The discretionary allowance on the first €400,000 of the taxable wage bill will increase from 2% to 2.16% with effect from 1 January 2027. This will give you a maximum of €640 extra discretionary allowance per year. This increase was adopted earlier and is therefore not part of the 2027 Tax Plan.

Tip! Update your staff handbook, expense claim policy and payroll administration in good time, and assess whether a higher mileage allowance is desirable from both a financial and employment conditions perspective. Does your organisation offer staff discounts on sector-specific products? If so, consider what the end of this exemption will mean. This will mainly affect the retail and manufacturing sectors.

3. Driving fossil-fuelled vehicles to become more expensive; ‘youngtimer’ scheme limit extended to 20 years

If, as an employer, you make a passenger car with emissions available to an employee for private use from 2027 onwards, you will be subject to a pseudo-final levy of 12 per cent of the list price. This levy is in addition to the employee’s additional tax liability and must not be passed on to the employee. Transitional provisions apply to cars made available before 1 January 2027.

The pseudo-final levy was already adopted last year, but following consultation, four amendments are being proposed.

  • For example, the levy does not apply to replacement transport during the first fourteen calendar days of maintenance or repair.
  • Manual-gear driving school cars are also exempt.
  • Until 31 December 2030, an exemption also applies to a fossil-fuel-powered passenger car that an employer makes available for private use no more than once per calendar year for a maximum of seven consecutive days. For example, in the case of a short-term hire car or a shared car.
  • Finally, the transitional rules for fossil-fuelled passenger cars made available before 1 January 2027 will be extended until 31 December 2030.

The ‘youngtimer’ scheme will be scaled back more gradually than previously stipulated, and the changes will be less far-reaching. The additional tax liability will continue to be based on the market value, but the age limit will rise from 16 years to 17 years in 2027 and to 20 years from 2028 onwards. The previously planned rapid increase to 25 years from 2027 will therefore not go ahead.

Transitional provisions apply to cars that have already been made available by 31 December 2025 at the latest and which will be 17 years old in 2027. These cars may continue to benefit from the youngtimer scheme throughout 2027. From 1 January 2028, the scheme will only apply to cars older than 20 years.

For employers, the decision to provide a company car is becoming increasingly important, particularly due to the ‘pseudo-final levy’. The contract term, drive type and the date on which a car is first made available can have significant tax implications. As a result, an existing lease plan may turn out to be much more expensive or, conversely, much more attractive.

Tip! Before making any new leasing decisions, carefully assess the total employer costs, the employee’s additional tax liability, the lease term and the transitional tax rules.

4. A lower inflation adjustment increases the tax burden in Box 1

Normally, the thresholds for tax bands and various tax credits in Box 1 rise in line with inflation. This means that the tax burden normally remains the same as income rises, in line with inflation.
In 2027 and 2028, the government will apply the inflation adjustment only partially. Without this measure, the inflation adjustment for 2027 would amount to 2.6 per cent. Of this, 48 per cent will be applied. As a result, tax band thresholds and tax credits will rise less in line with inflation. Incidentally, the 48 per cent is not applied to the second tax bracket threshold, which therefore remains the same in 2027 as in 2026. The first tax bracket threshold rises from €38,883 to €39,247. The second tax bracket threshold remains at €78,426.

At the same time, the Box 1 rates are changing. For taxpayers under the state pension age, the rate in the first tax bracket will rise by 0.48 per cent: from 35.75 per cent in 2026 to 36.23 per cent in 2027. The rate in the second tax bracket will rise by 0.60 per cent: from 37.56 per cent to 38.16 per cent. The rate in the third tax bracket remains at 49.50 per cent.

Due to the increase in rates and limited indexation, the tax burden in Box 1 will rise. This effect is mitigated for homeowners who can also deduct their mortgage interest at the higher rate of up to 38.16%.

Please note! Always assess your salary, dividends and profits in conjunction with one another. The tax burden may in fact be unexpectedly higher, as the general tax credit depends on your aggregate income. This may therefore also fall as a result of a dividend payment.

5. Postponement of Box 3

Box 3 taxes private assets, such as savings, investments and a second home. Under the current system, the tax authorities calculate the return largely using flat-rate figures. If your actual return is lower, you can provide evidence to the contrary, subject to certain conditions.

The Government has provisionally deferred consideration of the ‘Actual Return on Box 3’ Bill. It will present a new proposal in the 2027 Spring Memorandum. Consequently, the intended introduction on 1 January 2028 will not take place, or at the very least, this date remains uncertain. The Government is re-examining whether a capital gains tax would be more appropriate than a capital appreciation tax.

Under a capital appreciation tax, even an unrealised increase in value is taken into account annually. Under a capital gains tax, tax is only levied upon, for example, the sale of an asset. For entrepreneurs and directors/major shareholders with investments, let property or other assets that are difficult to sell, this makes a significant difference.

Please note!Until a new system comes into force, it remains important to keep accurate records of interest, dividends, rent, costs and changes in value. This information is required for the rebuttal scheme and for weighing up whether to invest privately or through a private limited company.

Tip! Do not wait for the new system. Record the actual return on each asset annually and retain the supporting documents.

6. Greater support for innovation and sustainability

The government is making various tax schemes for investment and innovation more attractive. For example, the energy investment allowance will rise from 40% to 45.5% with effect from 1 January 2027. Are you investing in qualifying energy-efficient business assets? If so, you’ll be able to deduct a larger portion of your investment from your profits.

The tax relief for research and development work is also being extended. The flat-rate hourly wage will rise from €29 to €33. This scheme reduces the payroll tax you, as an employer, pay when your employees are working on technically new products, processes or software.

Does your business make use of the innovation box? This scheme is also being made more attractive. From 1 January 2027, the maximum flat-rate amount will rise from €25,000 to €100,000 per year. The flat rate remains capped at 25% of profit. The current three-year application period will also remain unchanged. This allows you to have a larger proportion of your profit taxed at the lower Innovation Box rate.

Tip! Do you wish to make use of the energy investment allowance? Before entering into any commitments, check whether the business asset is included on the energy list. Then submit your application to RVO within the applicable three-month deadline.

7. Tax incentive for start-ups and scale-ups

To stimulate innovation and growth in specific young enterprises, the government is introducing an attractive tax scheme for employee share options at start-ups and scale-ups.

In principle, the employee pays tax when they actually sell the shares acquired through the options. After deducting the exercise price attributable to the shares, only 65 per cent of the benefit is taxed as income, subject to certain conditions. If the employee sells the share option right rather than the shares themselves, this lower tax base does not apply. The employee may also opt in writing for earlier taxation at the time the option right is exercised or as soon as the shares become tradable.

The scheme applies only to companies that qualify as start-ups or scale-ups and hold a decision from RVO. This decision is valid for eight years from the date of issue. Subject to certain conditions, you may extend the decision in five-year increments, up to a maximum total duration of 23 years. In addition, in principle, there must be a minimum period of two years between the grant of the share option and the sale of that option or the shares resulting from it. If the employee sells earlier due to a sale following the company’s initial public offering (IPO), an exception applies and the rule does apply.

The scheme is due to come into force on 1 January 2027. The definitive date of entry into force will be determined by Royal Decree. Share option rights granted on or after 17 April 2025 may also be eligible for the scheme. For this to apply, the share option rights must not yet have been included in payroll tax as at 31 December 2026, and the other conditions must be met. In that case, your company must apply to the RVO for the decision by 31 December 2027 at the latest.

Tip! Check in good time whether your company is eligible for an RVO decision. Also consider whether employee participation can help you attract, reward and retain talent.

8. Higher Aof contribution due to the ‘freedom contribution’

Employers must also pay a so-called ‘freedom contribution’ to fund rising defence expenditure. The government intends to collect most of this additional burden through an increase in the contribution to the Disability Fund (Aof). According to estimates, this increase will generate €1.5 billion in additional contribution revenue in 2027. From 2028 onwards, this will amount to €1.7 billion per year on a structural basis.

The high and low Aof contribution rates have not yet been finalised. The contribution rates will be announced at a later date, alongside the annual contribution rates for employees’ insurance schemes. As a result, it is not yet clear exactly how much your employer’s contributions will increase.

Tip! Allow for higher employer’s contributions in your 2027 staff budget. Adjust your payroll cost calculations as soon as the high and low AOF contribution rates for 2027 have been officially set.

9. Transfer tax on investment properties rises to 7%

Are you buying a property in which you will not be living yourself on a long-term basis? If so, you will pay transfer tax at the standard residential rate. This applies, for example, to a let property or a holiday home. From 1 January 2027, this rate will fall from 8% to 7%. The 2% rate for a property in which you will be living yourself and the first-time buyer’s exemption remain unchanged.

Please note! This reduction does not apply to commercial premises. In the case of mixed-use properties, conversions and property development projects, there may be some debate as to which part qualifies as a residential property. The use and condition of the property at the time of acquisition play an important role in this regard.

Due to the rate reduction, it may be worth reconsidering the timing of the transaction. You should also take other factors into account, such as financing, return on investment, VAT and the legal structure.

Tip! Before signing the purchase agreement, have an assessment carried out to determine which rate applies to your situation. In doing so, investigate whether it is sensible and feasible to postpone the transfer of title at the solicitor’s office until after 1 January 2027.

10. Tax relief on specific healthcare costs to end in 2028

Certain non-reimbursed healthcare costs are currently tax-deductible under specific conditions. These include specific medicines, medical aids, dietary costs, transport and additional family care. The relief only applies after any reimbursements and an income-related threshold have been taken into account.

The Government is abolishing the deduction for specific healthcare costs with effect from 1 January 2028. The associated scheme for reimbursement of specific healthcare costs, the TSZ scheme, will also be abolished. For people with a chronic illness, the Government is working on a targeted compensation scheme. The bill does not include any transitional provisions. The measure primarily affects people with a chronic illness, a disability or structurally high, non-reimbursed healthcare costs. Entrepreneurs and directors/major shareholders may also face higher net personal tax liabilities as a result. The financial impact varies greatly, as not every out-of-pocket healthcare expense is currently tax-deductible.

Tip! Make a list of your recurring deductible healthcare costs. This will show which tax benefits may be lost from 2028 onwards and to what extent a future compensation scheme will cover them.

Geen 2% overdrachtsbelasting bij niet bewonen door claustrofobie

2 of 8% overdrachtsbelasting

Op de levering van een woning is in 2026 in principe 8% overdrachtsbelasting verschuldigd. Gebruik je de woning na aankoop anders dan tijdelijk als hoofdverblijf, dan geldt een tarief van 2%.

Let op! Voor starters geldt, onder voorwaarden, eventueel nog een startersvrijstelling.

Onvoorziene omstandigheden

Het kan zijn dat een koper een woning niet anders dan tijdelijk als hoofdverblijf kan gaan gebruiken door onvoorziene omstandigheden. In zo’n geval wordt de woning dan geacht toch anders dan tijdelijk als hoofdverblijf gebruikt te zijn en kan het 2% tarief van toepassing blijven.

Doorverkoop na iets meer dan een maand

Er moet dan wel echt sprake zijn van onvoorziene omstandigheden. Een koper die een appartement kocht en niet bewoonde, vond dat in zijn geval sprake was van onvoorziene omstandigheden.

De dag na de levering van de woning kwam hij enige tijd vast te zitten in de lift. Door verslechtering van zijn gezondheid, kon hij moeilijk gebruikmaken van de trap. En vanwege zijn claustrofobie durfde hij na het liftincident, niet meer in de lift. Hij verkocht het appartement daarom binnen iets meer dan een maand weer door, zonder er zelf gewoond te hebben.

Claustrofobie geen bijzondere omstandigheid

De rechter vond dat er geen sprake was van onvoorziene omstandigheden. De lift was op het moment van aankoop van het appartement al aanwezig. Bovendien was niet aannemelijk dat sprake was van structurele gebreken of onveilige situaties met de lift. Het vast komen te zitten in de lift, was naar het oordeel van de rechter geen onvoorziene omstandigheid, ook niet in het licht van de claustrofobie.

Gevolg was dat over de levering van de woning 10,4% (het toenmalige tarief) overdrachtsbelasting verschuldigd was in plaats van 2%.

Tot € 1.250 subsidie voor jouw cyberweerbaarheid

Wat houdt de subsidie in?

Via Mijn Cyberweerbare Zaak is er in 2026 opnieuw €1 miljoen beschikbaar voor ondernemers die hun cyberweerbaarheid willen vergroten. De subsidie vergoedt 50% van de kosten voor de aanschaf of implementatie van een of meerdere cyberweerbaarheidsmaatregelen, met een maximum van €1.250 per aanvrager. 

Let op! Het budget wordt verdeeld op volgorde van binnenkomst, dus op is op, ook als dat eerder is dan de sluitingsdatum van 30 november.

 

Voor wie?

De subsidie is bedoeld voor zzp’ers en mkb-bedrijven met maximaal 50 medewerkers en een jaaromzet van maximaal €10 miljoen.

Waarvoor kan je de subsidie inzetten?

  • De subsidie geldt voor acht categorieën maatregelen:
  • veilige netwerktoegang of wifi,
  • een wachtwoordmanager,
  • tweefactorauthenticatie (2FA) of multifactorauthenticatie (MFA),
  • Patch-management, oftewel tools of diensten voor het automatisch controleren en uitvoeren van beveiligingsupdates,
  • antivirussoftware,
  • het instellen en testen van back-ups,
  • een risico-inventarisatie en -evaluatie (RI&E), en
  • een cyber awareness training voor je medewerkers.

 

Tip! Twijfel je waar je moet beginnen? Doorloop eerst de gratis CyberVeilig Check. Je krijgt dan een persoonlijke actielijst met verbeterpunten, die je meteen kunt gebruiken bij je subsidieaanvraag.

Let op!Niet alles komt in aanmerking. Certificeringskosten kunnen niet worden vergoed vanuit de subsidie. Maatregelen voor websites, webshops, online platformen, betaalsystemen en cloudwerkplekken vallen ook niet onder deze regeling.

 

Hoe vraag je de subsidie aan?

De aanvraag verloopt in drie stappen. Eerst doorloop je de CyberVeilig Check en download je je actielijst. Daarna schaf je de maatregelen aan die op je actielijst staan en die in aanmerking komen voor subsidie, en bewaar je de facturen en betaalbewijzen. Tot slot dien je je aanvraag in bij de Rijksdienst voor Ondernemend Nederland (RVO), inclusief je actielijst, factuur en betaalbewijs. Let erop dat je maar één aanvraag per bedrijf kunt doen, dus verzamel al je facturen voordat je een aanvraag indient.

Tip! Je hoeft niet alle maatregelen uit je actielijst al te hebben doorgevoerd om in aanmerking te komen.

Let op!Heb je al eerder subsidie gekregen voor een bepaalde maatregel, dan kun je daar niet nogmaals subsidie voor aanvragen. Je komt ook niet in aanmerking voor de subsidie als je zelf cyberweerbaarheidsmaatregelen aan anderen levert.

VvE kan niet-aftrekbare btw doorschuiven naar leden-ondernemers

Btw-ondernemerschap VvE

Voor het beheer en onderhoud van gemeenschappelijke delen van een onroerende zaak is een VvE geen btw-ondernemer. Hierdoor is de financiële bijdrage die de leden betalen aan de VvE ook niet belast met btw. Keerzijde daarvan is dat de VvE geen recht heeft op aftrek van btw op kosten die betrekking hebben op deze beheers- en onderhoudsactiviteiten. 

Voor ander activiteiten, zoals de exploitatie van laadpalen of de verhuur van ruimten, kan een VvE wel btw-ondernemer zijn. Daardoor kan een VvE wel recht hebben op aftrek van btw op kosten die betrekking hebben op deze btw-belaste activiteiten van de VvE.

Let op! Als de verhuur van ruimten is vrijgesteld van btw, kan de VvE de btw die daarop betrekking heeft ook niet in aftrek brengen. De onderstaande goedkeuring geldt niet voor deze niet-aftrekbare btw.

Goedkeuring

Omdat de VvE de btw op de beheers- en onderhoudskosten niet in aftrek kan brengen, vormt de btw een kostenpost. Dit kan tot cumulatie van btw leiden als de VvE leden-btw-ondernemers heeft die wel recht op btw-aftrek hebben. Daarom bestond vroeger al een bestendige gedragslijn die in 2011 als goedkeuring is opgenomen in het  Besluit Aftrek van omzetbelasting. Deze goedkeuring houdt in dat de leden-btw-ondernemers de door de VvE niet in aftrek gebrachte btw onder voorwaarden – naar rato- in aftrek mogen brengen. Op deze manier wordt de btw op de beheers- en onderhoudskosten doorgeschoven naar deze leden.

Het bedrag dat zij in aftrek mogen brengen, wordt berekend naar rato van de financiële bijdrage van de betreffende btw-ondernemer aan de vereniging.

Let op! Een ondernemer-lid dat de btw op de beheers- en onderhoudskosten in aftrek brengt op grond van deze goedkeuring, neemt voor de btw-heffing alle rechten en verplichtingen op zich alsof de btw aan hem in rekening is gebracht en alsof hij de beschikkingsmacht over het goed heeft verworven. Dit betekent dat de ondernemer eventueel ook rekening moet houden met de btw-herzieningsregels.

Verruiming goedkeuring in 2026

In de oorspronkelijke goedkeuring stond als voorwaarde dat de VvE niet mocht kwalificeren als btw-ondernemer. Omdat tegenwoordig steeds vaker voorkomt dat een VvE naast haar reguliere activiteiten, waarvoor zij geen btw-ondernemer is, ook btw-belaste activiteiten verricht, is deze voorwaarde verruimd. Nu geldt als voorwaarde voor de doorschuifmogelijkheid dat de VvE de betreffende goederen en diensten waarop de btw drukt, niet als ondernemer heeft aangeschaft. Hierdoor kan een VvE de btw op kosten voor haar reguliere activiteiten doorschuiven naar haar leden-btw-ondernemers, ondanks dat zij wel btw-ondernemer is voor eventuele andere activiteiten.

Afkoop lijfrenten zonder revisierente bij langdurige arbeidsongeschiktheid

Revisierente

Je betaalt bij afkoop normaal gesproken revisierente, omdat je dan onterecht hebt geprofiteerd van de premieaftrek. De revisierente bedraagt in de meeste gevallen 20% van de afkoopsom.

Niet bij langdurige arbeidsongeschiktheid

Er is geen revisierente verschuldigd als de lijfrente wordt afgekocht in geval van langdurige arbeidsongeschiktheid. De wetgever ziet in dat geval de afkoop niet als misbruik, omdat arbeidsongeschiktheid veelal gepaard gaat met een verlies aan inkomen.

Verplicht ineens afkopen?

Het was niet helemaal duidelijk of je van deze uitzondering alleen gebruik kan maken bij volledige afkoop van de lijfrente. De Belastingdienst heeft op vragen daarover geantwoord dat de lijfrente niet in zijn geheel hoeft te worden afgekocht om van de uitzondering gebruik te kunnen maken. Het is dus ook mogelijk de lijfrente in gedeeltes af te kopen, waarbij iedere keer geen revisierente betaald hoeft te worden.

Geen limiet

De Belastingdienst heeft ook aangegeven dat er geen limiet is in het aantal keren dat een lijfrente vanwege langdurige arbeidsongeschiktheid kan worden afgekocht zonder dat revisierente verschuldigd is. Wel moet de afkoopsom jaarlijks onder een hiervoor bepaalde grens blijven. In 2026 bedraagt deze grens € 51.440.

Let op! Als het gemiddelde van de premiegrondslag in 2026 en 2025 hoger is dan € 51.440, bedraagt de grens in 2026 dit gemiddelde.

Voorwaarden

Je kunt alleen onder voorwaarden van de uitzondering gebruikmaken. Zo mag je de AOW-leeftijd nog niet hebben bereikt. Daarnaast moet de situatie van langdurige arbeidsongeschiktheid aannemelijk gemaakt kunnen worden. Dit kan via een verklaring van een arts of met behulp van een schriftelijk stuk, waaruit blijkt dat je een uitkering wegens arbeidsongeschiktheid krijgt of gaat krijgen.

Aangifte en aanslagen inkomstenbelasting (IB)

Het was al mogelijk om in je berichtenbox aan te geven dat je de uitnodiging tot het doen van aangifte IB en je voorlopige en definitieve aanslag IB niet-winst alleen nog digitaal van de Belastingdienst ontvangt.

De digitale post komt in je berichtenbox op Mijn Overheid en/of in je berichtenbox app. Je kunt zo’n keuze weer herzien. Vanaf dat moment ontvang je de post van de Belastingdienst weer op papier.

Let op! Zet wel je e-mailnotificatie aan in Mijn Overheid zodat je een e-mail krijgt als er digitale post is.

Tip! De Belastingdienst heeft op de website een stappenplan voor het kiezen voor digitale post.

Zakelijk post

In Mijn Belastingdienst Zakelijk kun je nu ook doorgeven dat je zakelijke post alleen nog digitaal wilt ontvangen. Je ontvangt dan niet meteen alle zakelijke post digitaal. De Belastingdienst geeft aan dat de eerste brieven over de btw binnenkort digitaal beschikbaar zijn. Daarna komen de overige btw-brieven en tot slot de post over andere zakelijke belastingen digitaal beschikbaar.

Verzuimboete te late aangifte

Als je niet of te laat je aangifte inkomstenbelasting (IB) of vennootschapsbelasting (Vpb) doet, kan de Belastingdienst je een verzuimboete opleggen. Deze verzuimboete bedraagt in 2026 voor de IB € 469 voor een eerste verzuim en kan oplopen tot € 6.709 bij vaker verzuim.

Voor de Vpb is de boete veel hoger, namelijk in 2026 € 3.354 bij een eerste verzuim. Deze verzuimboete kan bij vaker verzuim ook oplopen tot € 6.709.

Let op! Er is pas sprake van een verzuim als je niet binnen de op de aanmaning vermelde termijn je aangifte hebt ingediend. Ontvang je een aanmaning vanwege het niet indien van je aangifte, dien dan binnen die termijn alsnog je aangifte in.

Eerste verzuim bv

Een bv had de aangifte Vpb te laat ingediend. Het betrof een eerste verzuim. De bv gaf aan dat dit kwam omdat vergeten was uitstel aan te vragen voor het indienen van de aangifte. De Belastingdienst legde een verzuimboete op naar een bedrag van € 2.757 (het toen geldende bedrag bij een eerste verzuim). Na bezwaar van de bv, verminderde de Belastingdienst de verzuimboete naar € 1.000.

De bv vond de verzuimboete van € 1.000 nog steeds disproportioneel in verhouding tot het verzuim. De bv vond zichzelf ook vergelijkbaar met een eenmanszaak en vond dat de boete ook daarmee vergelijkbaar moest zijn.

Vergelijkbaar met eenmanszaak

De rechtbank vond de bv ook vergelijkbaar met een eenmanszaak. De bv had een omzet die paste bij een eenmanszaak (de omzet was in 2022 € 196.960). Daarnaast was sprake van een eerste verzuim en had de bv de aangiftes van latere jaren wel op tijd ingediend. Om die reden vond de rechtbank de verzuimboete van € 1.000 te hoog en verlaagde deze naar € 500.

Let op! De Belastingdienst heeft zich in deze casus neergelegd bij het oordeel van de rechtbank en geen hoger beroep ingesteld.
